Terms of Service
These Terms of Service (“Terms”) apply to your use of the Crystal Hospitality Group website (the “Site”) located at crystalhg.com and any related subdomains. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Crystal Hospitality Group
Crystal Hospitality Group is a full-service hotel renovation and conversion contractor headquartered in Tampa, Florida. We serve hotel owners, ownership groups, franchisees, and brand partners across the United States. References to “Crystal,” “we,” “us,” or “our” in these Terms refer to Crystal Hospitality Group and its affiliates.
2. Intellectual Property & Brand Marks
All content on the Site — including project photography, case studies, written copy, video, logos, graphics, layouts, source code, and original designs — is owned by Crystal Hospitality Group or its licensors and is protected by United States and international intellectual property laws. You may view and share Site content for personal, non-commercial reference. Any reproduction, republication, distribution, scraping, training of machine-learning models, or commercial use without prior written permission is prohibited.
“Crystal Hospitality Group,” the Crystal logo, and the tagline “Every Facet. Every Detail.” are trademarks of Crystal Hospitality Group. Hotel brand names referenced on the Site — including Marriott, Hilton, Hyatt, IHG, and others — are the property of their respective owners. Reference to a brand does not imply endorsement, partnership, or affiliation beyond the specific projects identified.
3. Permitted Use of the Website
You agree to use the Site only for lawful purposes and only as permitted by these Terms. You agree not to:
- Copy, reproduce, modify, or distribute Site content without written permission from Crystal Hospitality Group.
- Use any automated system, including bots, scrapers, crawlers, or data-mining tools, to access or extract Site content beyond what is permitted by our robots.txt file.
- Reverse engineer, decompile, or attempt to derive the source code of any software made available on the Site.
- Interfere with the operation of the Site, attempt to gain unauthorized access to any portion of it, or transmit malware or harmful code.
- Misuse contact forms or other interactive features, including submitting false information, sending unsolicited commercial communications, or impersonating another person or entity.
- Use the Site, its content, or any information obtained from it to compete with Crystal Hospitality Group or solicit our clients, employees, or vendors.
4. Accuracy of Website Information
Information on the Site is provided for general informational purposes. Project descriptions, timelines, square footage figures, room counts, dollar values, and similar details reflect representative engagements and may be summarized, rounded, or anonymized. Past project results are not guarantees of future outcomes.
Pricing, schedule, scope, and capability references on the Site are illustrative and subject to change. Specific terms for any engagement are established only in a written agreement signed by both parties. Crystal Hospitality Group does not warrant that the Site is error-free, complete, or current, and reserves the right to update or remove content at any time without notice.
5. Project Inquiries & No Contract via Website
Submitting a project inquiry, completing a contact form, or otherwise communicating with Crystal Hospitality Group through the Site does not create a contractual, fiduciary, or agency relationship between you and Crystal. No statement on the Site or in any preliminary communication constitutes an offer, acceptance, bid, proposal, or contract.
A binding contractual relationship is established only when a written agreement — such as a Master Services Agreement, project contract, AIA contract document, or change order — is signed by authorized representatives of both parties. Until a signed agreement is in place, Crystal Hospitality Group has no obligation to perform any services, and you have no obligation to retain Crystal.
6. Project Contracts & Commercial Terms
All commercial terms governing a project — scope, pricing, schedule, payment, change orders, warranties, dispute resolution, and remedies — are established in the signed project agreement and any documents incorporated by reference. The summary below is provided for general transparency. In the event of any conflict between this summary and a signed project agreement, the signed agreement controls.
Scope of Work
The scope of each project is documented in writing, typically through a project contract, schedule of values, drawings, specifications, and any referenced brand standards. Verbal direction, marketing materials, and Site content are not part of the scope unless expressly incorporated into the signed agreement.
Change Orders
Any modification to project scope, materials, finishes, schedule, or contract sum must be documented in a written, signed change order. Work performed outside the original scope without an executed change order is performed at the requesting party’s risk and may be subject to additional cost, schedule impact, or both.
Payment Terms
Payment terms, including deposits, draw schedules, retention, accepted payment methods, and late-payment consequences, are specified in the signed project agreement. Crystal Hospitality Group reserves all rights available under the agreement and applicable law for non-payment, including suspension of work and lien rights.
Project Schedule & Excusable Delays
Project milestones and completion dates are established in the signed project agreement. Schedules account for excusable delays beyond Crystal’s reasonable control, which may include severe weather, force majeure events, supply-chain disruptions, owner-directed changes, undisclosed existing conditions, permitting delays, and delays caused by other parties. The procedures for time extensions and schedule adjustments are governed by the signed agreement.
Warranties
Workmanship and materials warranties are specified in the signed project agreement and any product-specific warranties provided by manufacturers and suppliers. Warranty terms, duration, limitations, exclusions, and remedies are governed by those documents. No warranty is created by any statement on the Site or in marketing materials unless expressly incorporated into the signed agreement.
7. Disclaimers
THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. CRYSTAL HOSPITALITY GROUP DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED ACCESS. CONSTRUCTION AND PROJECT-RELATED WARRANTIES ARE GOVERNED EXCLUSIVELY BY SIGNED PROJECT AGREEMENTS AND ARE NOT CREATED BY THE SITE.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Crystal Hospitality Group, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost data, loss of goodwill, or business interruption — arising out of or related to your use of the Site, even if Crystal has been advised of the possibility of such damages.
Crystal’s total aggregate liability arising out of or related to your use of the Site shall not exceed [LIABILITY CAP TO BE SET BY COUNSEL]. This limitation does not apply to liability that cannot be limited under applicable law. Liability for project work is governed exclusively by the signed project agreement and is not affected by this Section.
9. Third-Party Links & References
The Site may link to third-party websites, including brand partners, suppliers, industry organizations, and informational resources. Crystal Hospitality Group does not control these sites and is not responsible for their content, accuracy, availability, privacy practices, or terms of use. Links are provided for convenience and do not imply endorsement.
10. Privacy & Data Practices
Crystal Hospitality Group’s collection and use of information submitted through the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.
11. Indemnification
You agree to indemnify, defend, and hold harmless Crystal Hospitality Group, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses — including reasonable attorneys’ fees — arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Modifications to These Terms
Crystal Hospitality Group may update these Terms at any time. Updates take effect when posted to this page, and the “Last Updated” date at the top of the Terms reflects the most recent revision. Your continued use of the Site after an update constitutes acceptance of the revised Terms. We encourage you to review the Terms periodically.
13. Dispute Resolution
The parties agree to attempt in good faith to resolve any dispute arising out of or related to these Terms or your use of the Site through direct negotiation. If a dispute cannot be resolved through negotiation within thirty (30) days, the parties agree to submit the dispute to non-binding mediation before resorting to any other forum. Disputes that remain unresolved after mediation shall be resolved by binding arbitration administered under the rules of a mutually agreed arbitration provider, except that either party may seek injunctive or equitable relief in court to protect intellectual property rights. Disputes arising out of project work are governed by the dispute-resolution provisions of the signed project agreement.
14. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the dispute-resolution provisions above, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Hillsborough County, Florida, for any action arising out of or related to these Terms.
15. General Provisions
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect. Crystal’s failure to enforce any provision is not a waiver of that provision or of any other right under these Terms. These Terms, together with the Privacy Policy and any signed project agreements, constitute the entire agreement between you and Crystal Hospitality Group with respect to your use of the Site, and supersede any prior or contemporaneous communications on that subject. You may not assign these Terms without Crystal’s prior written consent.
